• L'article 10 de la Déclaration universelle des droits de l'homme est le suivant: «Everyone is entitled in full equality to a fair and public hearing by an independent and impartial tribunal, in the determination of his rights and obligations and of any criminal charge against him», alors que la deuxième phrase du paragraphe 1 de l'article 14 du Pacte international relatif aux droits civils et politiques est la suivante: «In the determination of any criminal charge against him, or of his rights and obligations in a suit at law, everyone shall be entitled to a fair and public hearing by a competent, independent and impartial tribunal established by law.».
  وفي المقابل، تنص الفقرة 1 من المادة 14 من العهد الدولي الخاص بالحقوق المدنية والسياسية، في جملتها الثانية، على ما يلي: "من حق كل فرد، لدى الفصل في أية تهمة جزائية توجَّه إليه أو في حقوقه والتزاماته في أية دعوى مدنية، أن تكون قضيته محل نظر منصف وعلني من قبل محكمة مختصة مستقلة حيادية، منشأة بحكم القانون".
